1. Acceptance of Terms

By downloading, installing, or using the PlaneBud mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PlaneBud is an aircraft management platform designed for Part 91 operations. The App provides tools for:

• Flight logging and tracking
• Aircraft maintenance and inspection management
• Squawk reporting and tracking
• Aircraft scheduling and reservations
• Organization member management
• Billing and financial tracking within organizations
• AI-powered assistance for aviation questions
• Logbook management

3. Account Registration

To use PlaneBud, you must create an account. You agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

4. User Responsibilities

You agree to use PlaneBud responsibly and in compliance with all applicable laws and regulations. Specifically:

• Accuracy of Data: You are responsible for the accuracy of all data you enter, including flight logs, maintenance records, and financial information.
• Not a Replacement for Official Records: PlaneBud is a supplementary tool. It does not replace official FAA logbooks, maintenance records, or any legally required documentation. You remain responsible for maintaining all required official records.
• No Aviation Advice: Information provided by the App, including AI chatbot responses, is for informational purposes only and does not constitute professional aviation, legal, or maintenance advice. Always consult qualified professionals and official FAA resources for critical decisions.
• Compliance: You must comply with all applicable Federal Aviation Regulations (FARs) and local laws regardless of any information displayed in the App.

5. Organizations

PlaneBud allows users to create and join organizations. Organization administrators are responsible for:

• Managing member access and roles within their organization.
• Ensuring appropriate use of shared organization data.
• Managing billing settings and financial records within the organization.

When you join an organization, certain data you contribute (flights, squawks, etc.) becomes accessible to other members as determined by the organization's settings and your role.

6. Subscriptions and Payments

• Free Tier: PlaneBud offers basic functionality at no cost.
• PlaneBud Pro: Additional features are available through a paid subscription. Subscription pricing and features are displayed in the App.
• Billing: Subscriptions are billed through the Apple App Store, Google Play Store, or Stripe, depending on your platform. All payments are subject to the respective platform's terms.
• Cancellation: You may cancel your subscription at any time. Access to Pro features will continue until the end of your current billing period.
• Refunds: Refund requests are handled according to the policies of the platform through which you purchased (Apple, Google, or Stripe).

7. Intellectual Property

The App, including its design, code, features, and content, is owned by PlaneBud and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content.
• Reverse engineer, decompile, or disassemble the App.
• Use the App's name, logo, or branding without permission.

You retain ownership of the data you enter into PlaneBud.

8. AI Chatbot Disclaimer

PlaneBud includes an AI-powered chatbot for convenience. You acknowledge that:

• AI responses may contain errors or inaccuracies.
• AI responses are not a substitute for professional aviation advice, certified flight instruction, or FAA guidance.
• You should independently verify any information provided by the AI before relying on it for flight safety or regulatory compliance.
• PlaneBud is not liable for any decisions made based on AI-generated responses.

9. Limitation of Liability

To the maximum extent permitted by law:

• PlaneBud is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or secure.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claims related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
• Aviation Safety: PlaneBud is not responsible for any aviation incidents, accidents, or regulatory violations. The pilot-in-command is always ultimately responsible for flight safety and regulatory compliance.

10. Indemnification

You agree to indemnify and hold harmless PlaneBud, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to PlaneBud at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the App ceases immediately.
• You may request export of your personal data before account deletion.
• Provisions that by their nature should survive termination will remain in effect.

12. Prohibited Conduct

You may not:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to the App or its systems.
• Interfere with or disrupt the App's infrastructure.
• Upload malicious code or content.
• Impersonate another user or entity.
• Use automated scripts or bots to access the App.
• Share your account credentials with others.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of PlaneBud after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
